Karakol: Municipal Land Taken on Lease by Cattle Market Owners is Arrested

After the journalistic investigation of the improper use of municipal land by cattle market owners in Karakol, the city court decided to arrest the leased land plot.

Last November, the journalists of CABAR.asia held an investigation of the improper use of municipal land leased by cattle market owners in Karakol.

It was found out that land plots rented to Bakyt Tulozhanov, according to documents, were intended for the installation of temporary commercial facilities but not for permanent facilities, for five years, and also for the car parking area. In fact, another cattle market was placed there.

The lessee used the land not as intended and gained profits both for parking and for every cattle located in the area. Tulozhanov performed the contract partially, with violations of health standards. Tulozhanov subleased his land plots to other persons for the installation of food pavilions, which is the violation of health standards. Also, Tulozhanov erected a concrete wall around the leased land and occupied the adjacent plots that didn’t belong to him. In fact, these plots belonged to the front part of the nearby Eldan mill.

Also, Tulozhanov fenced off the roadway of Chokan Valikhanov street, which was near the mill’s fence, and moved it 40 metres aside, which is unacceptable according to the official source darek.kg, a website with detailed zoning of streets and plots in Karakol. Chokan Valikhanov street is a fenced off area of overhead power transmission line.

During the investigation, the following violations were identified:

– the leased land intended for parking and installation of non-commercial facilities, according to documents, is used as a cattle market;

– illegal use of adjacent lands and gaining profits;

– violation of environmental and health standards;

– Chokan Valikhanov street was completely blocked and its territory was used as a car parking for trucks and as a platform for unloading of cattle.

Results

According to the head of Eldan Mill, Kantemir Baizakov, all the facts were proved during the official investigation held by Issyk Kul regional prosecutor’s office and the case was submitted to Karakol City Court.

Later on, Bakyt Tulozhanov dismantled concrete walls that blocked Valikhanov street, which was blocked earlier and used as a car parking area and a platform for unloading of cattle. Now the street has no obstacles.

By decision of the city court, the leased land was arrested and currently, the plot may not be used for commercial purposes.

According to available information, Bakyt Tulozhanov is planning to appeal the decision to the court of superior jurisdiction. We tried to contact him to update on this information. However, Tulozhanov was unavailable for comments by the time of this article.

According to the head of Eldan mill, Kantemir Baizakov, he is going to cancel the results of the bidding held by the Department of Municipal Property Management of Karakol city mayor’s office, which leased the land to Bakyt Tulozhanov. The bidding procedure was held with violations, which were reported in our previous journalistic investigation.
